Apostille or legalisation: which one do you really need?

Knowing what an Apostille actually is — and how it fits with a sworn translation — saves weeks of delay and files sent back for redoing. A practical guide, no textbook detours.

When an Italian document has to be used abroad — or a foreign one in Italy — the first question is almost never the price of the translation, but the stamp the receiving authority expects. Nine times out of ten the answer is a single word: Apostille. Knowing what this certification really is, who issues it in Italy and how it combines with a sworn translation makes the difference between a file closed in 48 hours and a week of rework.

What the Apostille actually is

The Apostille is a standardised stamp introduced by the Hague Convention of 5 October 1961. Its role is to certify the authenticity of the signature and status of the public official who signed a document, so that document is recognised in any signatory country without further consular steps.

In practice, one stamp — a single graphic sign — replaces every other cross-border procedure between Convention states. It is recognised today in more than 120 countries: France, Germany, the UK, the United States, Brazil, Australia, Japan, India, Mexico and many others.

Typical cases where you need it

  • civil-status certificates (birth, marriage, residence) for marriages or residence abroad;
  • diplomas and academic qualifications for university enrolment or public competitions abroad;
  • notarial deeds and special powers of attorney for real-estate or corporate operations;
  • company records and financial statements for international tenders;
  • criminal-record certificates for work visas or residence permits.

Who issues the Apostille in Italy

Italy has no single competent office: the request goes to the right authority depending on the type of act. Sending it to the wrong office means starting the whole file again.

Public Prosecutor's Office (Procura)

The Prosecutor apostilles judicial acts, notarial deeds, sworn translations and anything that passes through the Court's Chancellery. It is the competent authority for the vast majority of sworn-translation files.

Prefecture

The Prefecture handles administrative acts, civil-status certificates and state-issued academic titles from non-judicial public authorities.

Chamber of Commerce

The Chamber of Commerce handles trade documents digitally signed by a chamber-appointed public officer: company records, financial statements, certificates of company existence. For import/export operators it is the fastest channel.

When the Hague stamp is enough

For every Hague Convention state, the Apostille is the only stamp required: no further step, no intermediate authority. For non-signatory countries a different procedure applies, which we assess together before starting.

Apostille and sworn translation: the right order

The most frequent mistake is to invert the sequence between the stamp and the sworn translation. The practical rule is simple:

  • foreign document to be used in Italy: first the Apostille in the country of origin, then sworn translation in Court in Italy;
  • Italian document to be used abroad: first the sworn translation, then the stamp on the translation (and sometimes on the original too).

Realistic timing

Times vary by office. At the Prosecutor's Office in Milan the stamp is issued the same day or within 24 hours. In busier Prefectures times rise to 3–5 working days. For urgent files handled by the studio, 48–72 hours for the full sworn-translation + Apostille cycle is a realistic estimate.
